Janitors’ Victory in Houston Sparks Hope for New Era of Economic Gains for Families in America
City-wide union contract will more than double income for more than 5,300 janitors and families, latest victory in national fight for good jobs with health care

HOUSTON–On the heels of a string of victories in Miami, Los Angeles and Boston that have resulted in dramatic gains for families, more than 5,300 janitors in Houston won higher wages, more hours, and health insurance in their first city-wide union contract. The contract will lift hundreds of janitors out of poverty, more than doubling their income within 24 months and guaranteeing secure affordable health care. Houston is the second major victory for janitors in less than a year, and is being seen as a major breakthrough in the South and for low-wage workers around the country.

Workers, community, elected and religious leaders will join SEIU to hold a “Convention for the Future” to map out a plan to unite the approximately 1,700 workers who are not included in the recognition agreement and to build an anti-poverty campaign to take on low-wage jobs in early December. The convention will draw upon the strong coalition of faith, political and community leaders that stood with janitors during the strike.

“This is an incredible victory for our families and for all families,” said Ercilia Sandoval. “When I go back to work, I will go back proud of what we have accomplished, not just for us and our families, but for all of the workers in this city who work very hard but are paid very little. We showed what can be done, what must be done to make America a better place,”

The agreement provides Houston janitors with victories on four key fronts:

* Higher Wages. Janitors will see their wages rise by 126 percent over the course of the contract-with an immediate 21% increase on January 1. Janitors pay will increase to $6.25 an hour on January 1, 2007, $7.25 an hour on January 1, 2008, and $7.75 by January 1, 2009.
* More Hours. The new contract will increase work hours for janitors currently provided with only 4 hours of work a night to six hours a shift in two years. The additional hours and the wage increase mean that janitors who make $5.15 an hour will see their income more than double by the end of 2008.
* Quality, Affordable Health Insurance. At a time when many employers are shifting health care costs on to workers, Houston janitors won individual health insurance at a cost of only $20 per month. Family insurance will also be available for a cost of $175 a month. The health insurance will become available starting January 1, 2009.
* Paid Holidays and Vacation Time. The contract will allow workers-many for the first time in their lives-paid time off from work. Janitors will receive six paid holidays per year and be able to accrue paid vacation time beginning the first year of the contract.

The increase in wages and health insurance will dramatically improve the lives of 5,300 of Houston’s janitors, most of whom had been earning as little as $20 a day without benefits. The increase in wages and hours will lift many families out of poverty, and provide janitors and their families with a steppingstone into the middle class while the health insurance will ensure workers have access to affordable health care.

“Houston janitors have shown that organized labor still has the power to inspire and improve the lives of workers. When ably led workers unite, they can win major improvements,” said Julius Getman, a professor at the University of Texas Law School. “If low-wage janitors in Houston can win a victory of this magnitude, the message to workers throughout the South should be clear-in solidarity lies strength.”

In the last month alone, more than 10,000 workers of all races in every corner of the country-including the South-have risked their jobs to win a voice at work by voting to form a union. And tens of millions are demanding a change in direction by voting to realign the country politically.

* 5,000 security officers in Los Angeles–70% of whom are African Americans-made a major breakthrough Wednesday, securing their civil right to freely form a union with SEIU;
* 250 security officers who protect the Harvard campus won their right Wednesday to have a voice at work by organizing a union with SEIU;
* Nearly 500 Cuban and Haitian janitors at two South Florida universities, Nova Southeastern and Florida International, won a voice on the job last month;
* Nearly 4,000 nurses, technicians, professionals, and other hospital workers of all different ethnicities at six Florida hospitals voted to form a union with SEIU just since October 10.

The workers’ union efforts bring to life exit polls showing that 7 in 10 voters said their family’s economic situation had either gotten worse or stayed the same since the last election and 8 in 10 said the economy was “very or extremely important.” It also reflects recent polling showing that for the first time, a majority of parents in America believe their children will be worse off financially than they are. With a renewed focus on core economic issues, in the last election, six states passed laws to raise the minimum wage and voters elected a new Congress that campaigned explicitly on issues of raising the minimum wage and increasing access to quality, affordable health care.

Last fall, 5,300 Houston janitors made the historic choice to form a union with SEIU (Service Employees International Union). Their decision capped one of the largest successful organizing drives by private sector workers ever in the Southern half of the United States. Since forming a union with SEIU, Houston janitors have been seeking wage increases, more hours, and health insurance in a citywide union contract.

Congress passes legislation labeling activists as terrorists

House Passes Animal Enterprise Terrorism Act With Little Discussion or Dissent: Notes from the House Floor “Debate”
They did it. Corporations, industry groups and the politicians that represent them rushed through legislation labeling activists as “terrorists” on the first day back from Congressional recess. Just moments ago the House passed the Animal Enterprise Terrorism Act as part of the suspension calendar: in other words it was put on a list of non-controversial bills to pass with one swoop by voice vote.

Representative Bobby Scott, often called the go-to guy in the House on civil liberties and civil rights issues, came out swinging in support of the “eco-terrorism” bill. Not only did he not oppose the legislation, he lined up with the corporations, industry groups and conservative extremists in full support of it. Scott, a Democrat, said existing laws have been “reasonably effective” but “gaps and loopholes” prevent law enforcement from going after animal rights “extremists.” Scott failed to note, even in passing, that the existing law– the Animal Enterprise Protection Act– was used to successfully prosecute the SHAC 7 on “animal enterprise terrorism” charges for running a website. Scott dishonestly ignores this crucial bit of information, and said that activists are “taking advantage of the fact that” AEPA doesn’t cover “affiliates and associates” of animal enterprises: but that was, precisely, what the SHAC campaign was all about.

Disturbingly, Scott said in passing that civil disobedience would be covered in the bill– something other supporters of the bill have denied– but he tried to ease public fears by saying that the civil disobedience must cause disruption and loss of profits, and “it must be proven that such losses were specifically intended.” Bobby Scott, who frequently praises the achievements of the civil rights movement, stood on the House floor and advocated the inclusion of the tactics used by that movement in a “terrorism” bill. The only things that’s different between then and now, between the civil rights and animal rights movement, is the cause.

Representative Thomas Petri, a Republican from Wisconsin usually in stark contrast to Scott, said much of the same. He had the nerve to stand on the House floor and say, with a straight face, that “current federal law,” including the AEPA, has been “inadequate” in going after animal rights activists. Petri knows full well that ALL the crimes listed in this bill are already crimes, that the original bill has been used successfully, and that the animal and environmental movements have never claimed a single human life. Petri and the corporations that support him call the existing legislation “inadequate” because, in their mind, the true threat is not the underground wing of the movement, but the movement itself. That’s where this vague and overly broad legislation comes into place, wrapping up civil disobedience, undercover investigations and other non-violent activity as “terrorism.”

Only Representative Dennis Kucinich spoke up against this dangerous legislation. “This bill was written to have a chilling effect,” he said, “on a specific type of protest.” He also said that, “We have to be very careful of painting everyone with broad brush of terrorism.” And, in an interesting spin on the debate, Kucinich said lawmakers would be better off addressing animal issues and demonstrating their compassion.

He also raised what’s essentially a very conservative argument about the bill preempting existing law. A section of the bill says it shall not be construed

(3) to provide exclusive criminal penalties or civil remedies with respect to the conduct prohibited by this action, or to preempt State or local laws that may provide such penalties or remedies.

Kucinich noted that that’s precisely what the bill does. It provides exclusive penalties based on the beliefs of those who are accused.

Kucinich got in a little back and forth with James Sensenbrenner about the bill, with Sensenbrenner repeatedly citing a provision of the bill that “exempts” First Amendment activity. (Thank you to Senenbrenner and our patriotic members of Congress for reminding us that their is still a First Amendment. However, saying “this is Constitutional!” doesn’t make it so. If anything, it’s an admission that the bill has serious flaws.) At one point, Sensenbrenner read off a list of quotes from animal activists that he said exemplified the targets of the legislation. It was the same tired old list of quotes from the mid-90s and from a fairly recent Congressional hearing. Kucinich promptly noted that the quotes were exactly that: “Constitutionally-protected speech.” It’s misleading, he said, to say the bill exempts First Amendment activity, then use First Amendment activity as an example of why the bill is needed.

But perhaps the most disturbing segment of this whole scare-mongering debacle was when Sensenbrenner ended his comments, and ended the floor debate, by talking about the American Civil Liberties Union. He said the ACLU is the guardian of the First Amendment. He said the ACLU has a proud history of being a constitutional watchdog. And he said he has a letter, from the ACLU, saying they would not oppose this legislation and had no substantial concerns, essentially giving the Green Scare a green light.

armchair activist #19.1: emergency action to stop AETA

In typical behavior, the outgoing Congress is trying to pass as many messed-up bills as they can. On Friday, the House put the Animal Enterprise Terrorism Act (HR 4239, S3880) on the calendar for Monday (tomorrow!!). The bill will have no debate, it will be a simple vote up/vote down measure. So it is VITAL that you call your representative ASAP!

I don’t give a shit if you love killing puppies with your own bare hands, if this measure passes it will set the dominos in place for a complete gutting of our constitutional rights of free speech and assembly. If this measure passes, we may soon see similar legislation (even with the Dems in office) that not only marks animal rights activists as terrorists, but anyone who protests a corporation or government body (regardless of the tactics used) as a terrorist.
